Terms and Conditions
Boring but important stuff we have to have (but hope never to have to enact on):
This Contract contains the entire agreement between the parties. All terms and conditions of this
Contract shall be binding on the heirs, administrators, personal representatives and assigns of the Owner and the Kennel. This Contract shall be in force for this and all future boardings at Toolleen Country Retreat.
I agree to authorise you to take any necessary medical attention during the dog's stay, which if required, will be attending the nominated vet in Bendigo at my expense, plus transport fee of $100 per visit. I agree to pay all associated costs.
If my dog attacks another dog, damages fences, and/or bites staff, I agree to pay all associated costs. Owners of aggressive dogs will be asked to pick up their dogs early, with no refund for time booked.
It is expressly agreed by myself, the owner, and Kennel that Kennel's liability shall in no event exceed the lesser of the current chattel value of a pet of the same species or the sum of $200.00 per animal boarded. The Owner further agrees to be solely responsible for any and all acts or behavior of said pet while it is in the care of the Kennel.
The Kennel shall have, and is hereby granted, a lien on the pet for any and all unpaid charges resulting from boarding pet at the kennel. I hereby agree that in the event the boarding charges are not paid when due in accordance with this contract, the Kennel may exercise its lien rights upon ten days written notice given by Kennel to Owner by email to address shown on contract. Kennel may dispose of pet for any and all unpaid charges, at private or public sale, in the sole discretion of the Kennel, and Owner specifically waives all statutory or legal rights to the contrary. If such sale shall not secure a price adequate to pay such costs of board or other charges delinquent, plus costs of sale, then Owner shall be liable to Kennel for the difference. All monies realized by Kennel at such sale, over and above the charges due and costs of sale, shall be paid by Kennel to Owner.
I understand that despite vaccination, these vaccinations do not stop all diseases, but lessen the risk of getting some. As the kennels are run with strict cleaning and disinfecting routines, the risk of getting any disease is very small. However, the owner agrees not to hold the kennel/owners responsible for any disease that may occur as a result of staying at the kennel.
I understand that while every care is made to remove grass seeds after exercise sessions, agrees to not hold the kennel/owners responsible for grass seed removal and/or associated costs.
In the very unlikely event the dog escapes from the facility, whilst the owners will endeavour to retrieve the dog/s as quickly as possible, I agree to not hold the owners or the business responsible for such loss.
I specifically represent that I am the sole owner of the animal free and clear of liens and encumbrances.
